Order BEFORE: CELEBREZZE and LIVELY, Circuit Judges; and PHILLIPS, Senior Circuit Judge. The plaintiff-appellant, a 72-year-old forer miner, filed an application on October 31, 1972 for black lung benefits under the Federal Coal Mine Health and Safety Act of 1969, as amended. The application was denied upon consideration and, following enactment of the Black Lung Benefits Act of 1972, was denied upon reconsideration. The final decision of the Secretary was appealed to the district court which held in a memorandum opinion that, applying the required criteria, there is substantial evidence in this record to support the findings of the Secretary that the plaintiff Mr. Gentry was not totally disabled due to pneumoconiosis on or prior to June 30, 1973. The plaintiff then filed a notice of appeal to this court.
